Frequently asked questions about making a Will Part 1

Who should make a Will?

The short answer is everyone. However, depending on your intentions and assets, certain people are more in need of a Will than others for example, couple who are cohabiting, families with minor children or step children and people with a large estate.

What happens to any previous Will that I have made?

Upon signing a new Will, your old Will is revoked and deemed invalid. However, do not destroy your old Will until you have firs taken legal advice.

What is an Executor?

Executors are the people who will deal with your estate after your death. They will collect in your assets, pay your liabilities and distribute the estate according to the terms of your Will.

Who should I appoint as my Executor(s)?

You can appoint anyone that you wish to as long as they are over the age of 18 years. You can appoint up to four Executors, preferably a minimum of 2.  Some people chose to appoint a family member or alternatively a professional body, i.e. the solicitors acting for you.

Can a beneficiary be an Executor?

Yes.

What is a Mirror Will?

This is when you and a spouse/partner make a Will that contains the same provisions as your own i.e. they mirror each other.
