If you are a creditor trying to collect a debt you may be frustrated by the new Pre-Action Protocol which extends the time available to a debtor between the demand for payment and the point at which the creditor can issue Court proceedings.

Did you know that the minimum period for making the demand to commencing proceedings is now 30 days so that if you have already delayed the debt collection process the time when you can take action is extended even further.

The new Protocol applies to anyone owed money by an individual, sole trader or public body but does not apply to business to business debts unless the debtor is a sole trader.
