Disclosure in criminal cases

In the year to 30 June 2021, 1,648 cases were reported to have collapsed because of prosecution and police failings in the disclosure of key evidence. Experts believe that the actual figure is likely to be far higher as these issues are not always properly recorded.

The Police and CPS are required to disclose evidence to the defence that may undermine their case or be helpful to the defendant. However, an increasing number of people are being denied the evidence that may be vital to their acquittal.
