Employers - Can you dismiss an employee on suspicion

Employers – Can you dismiss an employee on suspicion only?

Lets say you strongly suspect an employee of misconduct but you do not have hard evidence or clear confirmation of serious wrongdoing.  Are you safe to dismiss an employee purely on suspicion or will you put the business at risk of an unfair dismissal claim?

Well the position is that providing you have a genuine belief that the employee is guilty of serious wrongdoing, and this is based on valid grounds/sufficient evidence, you can dismiss on the grounds of suspicion, but you must still carry out a thorough and reasonable investigation and consider all other possibilities.  If in doubt, do not dismiss but contact us for clear reliable advice on 01606 74301 or email [email protected] or [email protected]
