DEPARTING EMPLOYEE’S SICKNESS RECORD

TO A NEW EMPLOYER?

An employee’s sickness absence record is classed as “sensitive data” under GDPR and must not be disclosed to any third party without the employee’s express consent.

However, even if an employee consents, employers should think carefully before assuming the risk of being taken to task for inappropriate disclosure.
