Divorce procedure

Previously, if your marriage had irretrievably broken down and you believed that the only available option open to you was to start divorce proceedings, then you had to raise one of 5 reasons to divorce your spouse.

However, the divorce process in England and Wales changed in April 2022. The new procedure removed the need to prove “adultery”, “unreasonable behaviour” or “desertion” and ensures you do not need to wait two years (with consent) or five years (if no consent) to start the divorce.

The new procedure is more simplified and avoids the acrimonious nature of the previous fault based divorce.  No allegations or other reasons need to be inserted in the divorce application and the applicant just needs to confirm that the marriage has irretrievably broken down

Of course there are regularly other issues that need to be addressed either before or after divorce proceedings are started eg financial agreements and issues regarding children.
