MORE REDUNDANCY RIGHTS FOR PREGNANT EMPLOYEES

The Protection from Redundancy (Pregnancy and Family Leave) Act 2023 received Royal Assent in May 2023 and is expected to come into force after April 2024.

The Act makes several changes and grants certain employees additional employment rights.

At present if an employee is selected for redundancy during their maternity leave they must be offered any suitable vacancy which exists before colleagues who have been selected for redundancy.

The Act extends  existing redundancy protection rights so that they apply from the point the employee informs the employer (verbally or in writing) that they are pregnant until  18 months after the child’s birth.

It also extends redundancy protection rights in relation to suitable alternative employment for those employees who take adoption or shared parental leave.
