REQUESTS FOR EXTENDED LEAVE

There are many circumstances in which an employee may request extended leave eg to travel or for personal reasons.

An employee has no legal right to take an extended break from work for personal reasons and likewise there is no legal obligation for an Employer to keep an employee’s job open during an extended break.

However, an Employer may wish to come to an agreement with the employee if they want  to keep them on board and  to retain good relations.

Career breaks are not subject to any legislation and therefore the terms of any agreed break are a matter for negotiation between the parties eg will there be continuity of employment?

If an extended break is to be for months rather than weeks it is advisable for an Employer to break continuity of employment so that any employee will not be entitled to accrue holiday pay or receive sick pay should they become unwell  during their absence.

Any absence exceeding an employee’s annual leave entitlement is unpaid.
