From 1 April 2018, Minimum Energy Efficiency Standards (MEES) will require that all commercial residential buildings are let with a minimum energy rating of E, making it unlawful if Landlords do not meet this minimum requirement.

The regulations apply to the granting of new leases and lease renewals and, from 1 April 2023, the regulations will broaden to make all active leases unlawful for ‘sub-standard’ properties.

Landlords could face fines of up to £150,000.00 form the local authority should they let out an F or G rated property.

In addition, all infringements of the regulations will be made public.

Buildings currently rated D and E may also be at risk, as shown above, this accounts for 50% of offices in the UK with a registered EPC.

 EPC’s were first required in 2008 upon a property being constructed, sold or let and are valid for 10 years.  With the means of assessment becoming significantly more refined and regulated the assessments can provide a more accurate picture of the building which may be inconsistent with the EPC’s conducted in the early years.

This mean that properties currently rated D and E (account for 50% of offices in the UK with a registered EPC) could face the grade dropping to below E when reassessed, making the property unlawful to re-let.
