Employee Awarded £130,000 following exclusion from WhatsApp Group Chat

An employee on long-term sick  leave, who was excluded from his employer’s WhatsApp group chat because of his health condition,  has been awarded £130,000 in compensation by the Employment Tribunal after the Judge found that in this case the  exclusion amounted to disability discrimination.

Employers may exclude employees from work place communications if such contact would make the  employee’s condition or illness worse.

It is essential to agree with the employee what level of communication they would like  regarding work related issues during their sickness absence. Some may prefer no contact whilst others may feel excluded and isolated  if they are not kept informed.
