HAVE YOU MADE A WILL?

It is very important to have a Will in place.

A Will is a legal document that deals with the distribution of your estate after your death. Your estate includes all assets that you own at the date of your death. This could be anything from money in bank accounts, shares, business, property, pets, cash, clothing etc.

In the Will, you can also include important areas such as who you want to act as your Executor who is the person who will deal with your estate including settling any outstanding liabilities, collecting in assets, applying for Probate (if required) and distributing your estate in accordance with your Will and following your funeral wishes.

The funeral arrangements mentioned in a Will are not legally binding but can be important in providing guidance for your Executor. This can be helpful, for instance, if there was a query or dispute as to what you would have wanted. It also prevent someone else becoming involved in making the arrangements.

WHY YOU SHOULD MAKE A WILL WITH MOSSHASELHURST:

  • Your wishes will be clear and set out in writing – avoids uncertainty and stress for your loved ones in the event of your death
  • Your estate goes to who you want it to go to (if you do not have a Will, the Intestacy rules will be relevant and these could result in members of your family inheriting from your estate who you did not intend to benefit)
  • Having a Will makes the Probate process easier and much quicker. A Grant of Probate (which is issued where there is a Will) is processed quicker in comparison to a Grant of Letters of Administration (which is issued where this is no Will) as Grant of Probate is based on a digital application
  • You will receive exceptional legal advice relating to your Will from our Private Client Department who have a combined legal knowledge of 30 years between them
  • We will arrange the preparation and signing (this can be the most important part)
  • We will offer to store your original Will at our secure storage facility for free of charge, once completed
