Non-Molestation orders

A non-molestation order is an order made by a Family Court judge prohibiting a person from using or threatening violence against another or communicating with a named person or entering an area where the other person may be. It also forbids that person instructing or encouraging anybody else to carry out any of these actions on their behalf.

The applicant seeking the protection of a non-molestation order must be an associated person to the other party such as a spouse, former spouse, ex-partner, fiancé or even a relative.

There does not need to be a history of violence or other abuse to obtain a non-molestation order. An order can be made to stop one person harassing another.

Non-molestation orders can be made for any period of time but usually last for 12 months and they can be extended or renewed if necessary after the end of the period.

A breach of any of the terms of a non-molestation order will result in an arrest and a fine of up to £5,000 or 5 year prison sentence on conviction in a court.
