Pothole Compensation

In February 2025 the RAC received an average of 66 reports a day about potholes from broken down  drivers.  By February 2026 this had increased to an average of 235 reports a day.

Most drivers are likely to be put off by a long battle for compensation from the relevant Council particularly if a claim is rejected at the first hurdle but it can be possible to succeed with determination.

The road defect must be 40mm deep or more to be considered a dangerous pothole

Anyone seeking compensation should:-

  • Measure and take photographs of the pothole. Take a close up showing the ruler/tape measure
  • Obtain proof of the damage caused
  • Submit a claim immediately
  • Submit a Freedom of Information request from the Council asking for :
    • Inspection records for the last 12 months
    • All reports received about any road defect in the last 12 months and any action taken
    • Specification and criteria for temporary and permanent repairs
    • Copies of work orders to identify how the pothole was repaired.
