PREPARING FOR THE CHANGE TO UNFAIR DISMISSAL RIGHTS

From 1 January 2027 employees will have the right to claim unfair dismissal after 6 months’ continuous employment (reduced from 2 years).

Steps employers can take to prepare for this significant change :-

  • Reduce probationary periods to less than 6 months – ideally 3-4 months – with limited ability to extend
  • Diarise all probation period end dates
  • Implement formal processes and structures to assess new recruit’s performance, conduct and suitability for the role during the probation period
  • Decide on a new recruit’s continued employment by the end of the probation period
  • If a decision is made to dismiss ensure at least the statutory minimum notice period of 1 week is given and that the notice can be served before 6 months’ service has expired.
