Sweeping Reforms for Landlords and Tenants

The Renters Rights Act 2025 has been passed into law introducing sweeping reforms that represent the most significant changes to the private rental sector in England in over 30 years.

These reforms are designed to give tenants greater security and are likely to impact most private clients.

Three key headlines are:-

1.         The Act will abolish fixed term tenancies in the private rented residential sector replacing    them with assured periodic tendencies.

2.         Landlords will no longer be able to evict on a no fault basis at the end of a fixed term – they must prove prescribed grounds to terminate.    Constraints will be placed on a landlord's ability to increase rent during the tenancy and to charge rent in advance.

3.         Future Purpose Built Student Accommodation (PBSA ) will be exempt from the new regime if the PBSA operator is a member of the approved code and is letting to students at specified educational institutions.

This legislation sparked a surge in Section 21 Notice and tenant evictions with landlords attempting to protect their position before the Act came into force on 1 May last.  The Government was warned about this but went ahead regardless.
