Speed Awareness

When a speeding offence has been captured by camera, a Notice of Intended Prosecution (NIP or s172 notice) with a request to identify the driver will be sent to the registered keeper of the vehicle.

Dealing with this NIP promptly is important as it can be  key to whether or not you are offered a Speed Awareness Course.

The Police will offer a course if the offence is within the speed threshold, the identity of the driver is  provided correctly and a course has not already been offered within the past three years.

Accepting the course is an admission of guilt. We therefore recommend that you don’t request the course prior to it being offered.

There is also no automatic entitlement to a course. It is entirely at the discretion of the Police. The Police also have a discretion to withdraw the offer at any point before you take the course.

The course may prevent you from accumulating 12 points on your licence and then being disqualified under the “totting” provisions, unless an  “exceptional hardship”  argument can be raised.
